Terms of Use

These terms are the agreement between you and the developer of GymQuest for your use of the app. By installing or using GymQuest you accept them. If you do not, delete the app.

1. Not medical advice — read this one

GymQuest generates workout suggestions from the inputs you give it. It is a fitness app, not a doctor, physiotherapist or personal trainer, and nothing in it is medical advice. Exercise carries a risk of injury.

• Consult a physician before starting any exercise programme, especially if you are pregnant, have an injury, or have a heart, joint or blood-pressure condition.
• Use loads you can control, warm up, and stop immediately if you feel pain, dizziness or shortness of breath.
• You are solely responsible for deciding whether a suggested exercise or weight is appropriate for you, and you use the app at your own risk.

2. Licence

We grant you a personal, non-transferable, non-exclusive licence to use GymQuest on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, resell, reverse-engineer or redistribute the app or its exercise content, except where that restriction is prohibited by law.

3. GymQuest Pro subscriptions

• GymQuest is free to use. GymQuest Pro is an auto-renewing subscription offered monthly or annually; the exact price and duration are shown on the purchase screen in your local currency before you confirm.
• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends.
• Manage or cancel your subscription in iOS Settings → your Apple Account → Subscriptions. Deleting the app does not cancel a subscription.
• If a free trial is offered, any unused portion is forfeited when you buy a subscription.
• Purchases are handled by Apple. Refunds are at Apple's discretion under the App Store Terms of Service; we cannot issue them.
• Restore an existing subscription on a new device with the "Restore purchases" button on the purchase screen.

4. Your data

Your profile, workouts and progress are stored on your device, not on our servers, so we cannot restore them if you delete the app or lose the phone. What the app does send to third parties is set out in the Privacy Policy, which forms part of these terms.

5. Acceptable use

Do not use GymQuest unlawfully, attempt to defeat its purchase checks, or interfere with its operation or with other users' devices.

6. Availability and changes

We may add, change or remove features, and we may stop distributing the app. We will not knowingly cut short a subscription period you have already paid for.

7. Disclaimer and liability

The app is provided "as is", without warranties of any kind to the fullest extent permitted by law, including any warranty that the generated workouts are suitable, safe or effective for you. To the fullest extent permitted by law, our total liability arising out of your use of GymQuest is limited to the amount you paid for it in the twelve months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

8. Apple

Apple is not a party to these terms and has no obligation to provide support for GymQuest. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
